I am begging to the authorities of Switzerland: Please launch an investigation to punish the unlawful lawyer and all other accomplices in a timely, responsible, and transparent manner, as well as to verify if the process of the “surveillance of lawyers” in Geneva functions properly.

A Swiss lawyer and his client, a Ukraine oligarch’s company in Geneva, destroyed a decent citizen’s life by abusively misusing the Swiss legal system. The case concerns one citizen, it could happen to anybody, and relates to the sound functioning of legal practice in Switzerland.

The company unilaterally terminated a work contract in the middle of the term, without respecting the terms mentioned in the contract. For the company this was part of their restructuring process to migrate their IT infrastructure from Geneva to the Ukraine. There are lawful ways to reorganize a company, but that company dismissed workers from one day to the next without any prior notification based on false accusations, without paying the money due for the services already provided and without paying the necessary compensation.

Like everybody believing in the Swiss legal system, I could not accept such a groundless accusation and took legal action against it.  

Thereafter, the company recruited a famous lawyer who frequently appears in the media as an expert on media and IT matters. He advised the company to sue the innocent citizen for a quarter million Swiss franc in pretended damage (Read more), instead of paying the due monies. The lawyer and the company lied repeatedly to the tribunal for nearly six years, and they are continuing to do so. They have been dragging the case for so long with a whole set of invented irrelevant issues, to the point of opening a criminal case against the innocent citizen, using manipulatively presented facts, knowing the truth. After several years the innocent citizen won that case, and his innocence was proven.

The key strategy of the lawyer and the company is to suffocate the innocent citizen emotionally, psychologically, and financially, while the lawyer earns a lot of money. It doesn’t matter for him, how the final verdict will come out. No normal middle-class citizen in Switzerland can withstand the pressure of a continued series of so-called “legal” but in fact very aggressive invented attacks, that are all carried out by abusively using the legal system of Switzerland, as if it were a weapon that can willfully be used against innocent citizens. This kind of cooperation between a Swiss expert lawyer deliberately lying to benefit his own pocket while defending a multinational company, namely its Swiss subsidiary, is not what the Swiss legal system is meant for.

Note, that every lawyer has to take an oath in Geneva. Art. 27 of the  ‘Loi sur la profession d’avocat (LPAv)’ relates to that. See https://silgeneve.ch/legis/data/rsg_e6_10.htm. There it says, how a lawyer should practice his profession. This lawyer is disrespecting all the official entities involved in the legal system of Switzerland, including judges, other legal professionals, public officials, the police, etc.

Which authority is supposed to supervise that such abuses do not occur and investigate and punish a lawyer who willfully, openly, boldly, unashamedly, and knowingly lies?

According to the information on their website, the following entity called ‘Commission du Barreau’ oversees the surveillance of lawyers in the canton of Geneva: https://justice.ge.ch/fr/contenu/commission-du-barreau

If the Commission du Barreau had performed their lawyers’ surveillance duty actively, this kind of bold abusive lawyer’s behavior could not take place and it could not have continually lasted for over six years. The Commission du Barreau does not perform this duty proactively, but eventually only reactively, thus, the innocent citizen reported the lawyer’s abuse to it.

The Commission du Barreau has not taken any decision yet. They acknowledged the receipt of the letter and stated that they forwarded it to the respective lawyer(s).

The Swiss legal system should not allow such  abusive chain of failures:

• 1. A company failed to act according to the law.
• 2. A lawyer failed to practice his profession according to the oaths he took.
• 3. The entity in charge of lawyers’ proactive surveillance failed.
• 4. My efforts to inform the entity in charge failed (i.e. No replying to my further request for the information, having not resulted in an investigation yet, but letting the lawyer use my report outside the scope of the purpose- see below in detail).
• 5. On top of these failures, now I am at the mercy of that lawyer, as he is attacking me once more for the reason of my whistleblowing, instead of being righteous.

Upon request all the points can be proven by providing official legal documents.

A lawyer who abuses our legal system, and blatantly lies while practicing his profession, should be investigated, and punished, even more so a lawyer who financially profits from his lies, even more so, if he misuses the law like a weapon to destroy an innocent citizen’s life.

I denounced the wrongdoing of the lawyer under the instruction of the responsible authorities (Conseil d’Etat of Geneva and the Commission du Barreau) with the purpose of getting this thing corrected soon. However, what I have got is the additional count attack from the lawyer, instead of getting the wrongdoing corrected. I recently was ordered to present police station for “defamation” and “slanderous denunciation” . Apparently, the Commission had handed over all the contents of my report that I submitted to the Commission to the lawyer, which was used for the lawyer to open another criminal case against me. I did not get any minimum protection on my whistleblowing action from the revenge.

I am wondering if these series of events are incorporeally reflecting the fundamental value of Switzerland, as one of the most developed democratic countries in the world? 

Letting an innocent citizen continues to suffer in this manner, letting the money power from multinational company and social power from the famous lawyer in combination continue to destroy a life of innocent citizen.

Is this really the way of Switzerland, as one of most respected human society in the world?

This looks to me that it is not only justice issue but also humanity issue.

I am an innocent whistle-blower. I wish my whistling could reach the people behind the massive walls that have surrounded me.

I wish to get my ‘ordinary life’ back, and to prevent other innocent citizens become another victim like me.
